The Industry Standard has a very interesting, and cautionary, story concerning Apple and their lack of an e-mail retention policy.
In additon to specifically talking about Apple, the article links to several excellent resources concerning e-Discovery. If you don't have an e-mail retention policy, I highly recommend reading this article. Operating without a policy in this area could open the doors to some costly judgements against your company.

According to a recent legal filing . . . in the Psystar vs Apple antitrust case, Apple employees are responsible for maintaining their own documents such as emails, memos, and voicemails. In other words, there is no company-wide policy for archiving, saving, or deleting these documents.

personally I think that the policy to have no policy is probably a very good data retention policy. Some companies like to keep everything forever, others like to destroy everything the instant they can. Apple have a 'do what you think is appropriate' policy which means that they can't be accused of not following or enforcing their policy.
